1. Acceptance of Terms

By creating an account, placing an order, or registering as a vendor, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of a business, you represent that you are authorised to bind that business to these Terms.

2. Accounts & Registration

To use certain features you must create an account and provide accurate, current and complete information. You are responsible for safeguarding your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

• One person or legal entity may not maintain more than one account without our consent.
• You must verify your email address (and, where required, your mobile number) via the OTP we send.
• You are responsible for keeping your contact details up to date.

3. Vendor Programme

Vendors may apply to sell products on Bimba by completing the registration flow. All vendor applications are reviewed by our team, typically within 24 hours, and approval is at our sole discretion. By registering as a vendor you agree to the following:

• You will only list products you are legally entitled to sell and that comply with all applicable laws.
• Product information, images, pricing and stock levels must be accurate and kept up to date.
• You are responsible for fulfilling orders, honouring prices shown, and providing customer support for your products.
• Bimba may remove any listing or suspend any vendor account that breaches these Terms or our policies.
• Applicable commissions, fees and payout terms will be communicated to you and may be updated from time to time.

4. Orders, Pricing & Payments

All prices are listed in the applicable currency and are subject to change. We make reasonable efforts to display accurate pricing and availability, but errors may occur. If a product is listed at an incorrect price, we reserve the right to cancel the order. Payment must be completed through the payment methods offered at checkout. You agree that you are authorised to use any payment method you provide.

5. Shipping, Returns & Refunds

Delivery timelines, return windows and refund eligibility depend on the vendor and product. Please review the policy shown on the relevant product or vendor page before purchasing. Where a return is accepted, refunds are processed to the original payment method within a reasonable period after the returned item is received and inspected.

6. Prohibited Conduct

You agree not to use the Services to:

• Violate any law, regulation or third-party right, including intellectual property rights.
• Upload content that is fraudulent, misleading, defamatory, obscene or harmful.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorised access to any part of the Services or related systems.
• Use automated means to scrape, harvest or collect data without our permission.

7. Intellectual Property

The Services, including all text, graphics, logos, and software, are owned by Bimba or its licensors and are protected by intellectual property laws. Vendors retain ownership of the content they upload but grant Bimba a non-exclusive, worldwide licence to host, display and promote that content in connection with operating the Services.

8. Disclaimers & Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, Bimba shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Services.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately.

10. Changes to These Terms

We may revise these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
